We help our clients negotiate construction contracts and assist them in managing the risks inherent in the construction process. Our lawyers are accomplished negotiators who have successfully resolved complex and contentious matters on behalf of our clients. We employ both our expertise and common sense in resolving difficult and potentially costly disputes. Our concentration in construction law allows us to quickly focus on the key issues and formulate and implement either a reasonable settlement or, if necessary, arbitration or litigation. Our services include:
- Consultation. Consultation in contract negotiations and formations.
- Lien Claims. North Carolina's lien statutes are complex. Our attorneys prosecute and defend lien claims on a regular basis and are familiar with the intricate procedures that must be followed to preserve lien rights under North Carolina law.
- Performance Disputes. We work with Owners, General Contractors and Subcontractors to resolve the multitude of disputes that can arise during the construction of a project, including issues related to default and termination.
- Performance/Payment Bond Claims. We are experienced with the intricacies of protecting and enforcing the Owner's or the General Contractor's performance rights and obligations under performance bonds and the Subcontractor's rights under payment bonds.
- Litigation. We have experienced attorneys authorized to practice before every state and federal trial and appellate court in North Carolina. If your dispute cannot be resolved without a lawsuit, we are prepared to have it resolved through litigation. We know how to prepare for and try cases in a cost-effective manner and do so when necessary and appropriate.
- Arbitration. We have extensive experience in resolving construction disputes through arbitration. Our attorneys have appeared before a multitude of Arbitrators and Arbitration forums including the most common for construction industry disputes - The American Arbitration Association ("AAA"). John Bugg is a longstanding member of the AAA's construction disputes arbitrator panel, and our firm regularly has AAA arbitration proceedings pending at any given time.
